A wild fight for a prime real estate parcel in Nairobi is taking steps to part the kins of former Kathiani MP Wavinya Ndeti. The two groups of the family are said to be translating court verdicts to suit their side of the story. At the focal point of the contention are two court choices whereupon the two groups are sticking.
One of the sides of the family contends that a court request is being ignored in the continuous subdivision.
spouses and children of five siblings Patrick Mutheke, Julius Kiilu, Peter Nzuki(Wavinya’s dad), Harrison Mulili and Alifonce Nthiwua, cautioned the individuals who were sub-partitioning the land at the Mlolongo weighbridge on Mombasa Road.
They noticed that the people were against a 2014 Court of Appeal ruling.
The last born, Kivuto Ndeti’s family, which was previously accused of subdividing the land asserted that it was given organization rights by the high court in 2018.
The 100-section of land plot, which individuals from the Ndeti family esteem at adjoin Ksh1 billion, has been a bone of conflict for quite a long time since the late 1970s.
January 21, 2014, High Court Judge Justice William Musyoka offered a grant to Cecilia Situmai Ndeti, the widow of Professor Kivuto, and her son Kyende Ndeti a number of properties among them the Mlolongo parcel.
But in a twist, the Court of Appeal gave an order on July 11, 2014, barring any transaction on the same piece of land.
Justice Margaret Muigai on June 21, 2018, delivered a ruling on behalf of Justice Musyoka where the court saw no reason to quash the grant despite the Court of Appeal ruling which has never been contested.
The families of the elder brothers stated that Kivuto had stretched them to the limit and they decided to fight back and get what rightfully belonged to them before it is too late.
